USED CAR FRAUD
Massachusetts law Chapter 90 §7N 1/4 requires used car dealers to provide buyers with an express written warranty against defects that impair the vehicle's use or safety. For vehicles with less than 125,000 miles the warranty period is 30 days from the date of purchase.
The dealer must give you a signed, dated, correct copy of the limited used vehicle warranty at the time you purchase the vehicle. The warranty requires the dealer to repair any defect that impairs the vehicle's use or safety.
If the dealer fails to repair the same defect within three attempts, or if the car is out of service for more than a cumulative total of ten (10) business days after the consumer has returned it to the dealer for repair, then the dealer must take the car back and refund the full repurchase price, less a fifteen cents per mile for each mile driven since date of purchase.
If you believe you have been the victim of fraud in the purchase of a used car, contact the Law Office of Barbara L. Horan for a no-cost initial consultation.
